User Content (Interactive Features)

The Site may allow you to post content (text, photos, video, reviews, etc.) ("User Content"). This content is publicly viewable.

You are solely responsible for your User Content and use of any interactive features.

Prohibited Content:

You agree not to post, upload, or transmit any content that is:

• Harmful, abusive, harassing, or threatening.

Our Rights: By posting User Content, you grant opshop.kiwi a nonexclusive, royalty-free, worldwide, perpetual, and irrevocable right to use, reproduce, modify, and distribute that content for any purpose and without compensation to you.

Any questions, comments, suggestions, ideas, or reviews you submit regarding the Site or our products ("Feedback") are non-confidential and become the sole property of opshop.kiwi. We can use and share this Feedback without restriction or compensation to you.

7. Product Purchases

• Electronic Transactions: All transactions with us may be conducted electronically.
• Risk of Loss: The risk of loss and title for items you purchase pass to you upon our delivery of the items to the carrier (the shipping company).
• Pricing & Availability: All items are subject to availability. Prices are subject to change without notice. We reserve the right to correct errors, limit quantities, reject or cancel orders, even after they have been placed.
• Taxes and Shipping: You agree to pay all applicable shipping, handling charges, and sales tax based on the shipment destination.
• Payment Authorization: By submitting an order, you confirm you are authorized to use the designated payment method and authorize us to charge your order (including all applicable charges) to that method.

Payment Options

We currently offer two payment options:

1. VISA, Mastercard, Amex	Via Paystation. Your payment details have the security offered by Paystation, a fully PCI DSS compliant certified Solutions Provider.
2. AfterPay
3. Bank Transfer	Bank details will be emailed to you once order is submitted. Use your order number and surname as the reference. Payments received before 12 noon on normal business days are typically processed and shipped the same day (subject to bank processing times).
4. PayPal	Choose this option at checkout to pay securely by credit card or your PayPal balance. You will be directed to the PayPal site and then returned to opshop.kiwi upon completion.

8. Returns and Refunds Policy

Conditions for Return

All returned items must be in new condition, unworn, and unwashed.

Items that CANNOT be Returned (Change of Mind)

For hygiene and other reasons, we cannot accept returns for a "change of mind" on the following categories:

• Cosmetics, Fragrances, Bath & Body
• Underwear, Swimwear
• Dinner / Lunch items
• Toys or electronics
• Personalized printed material (photos, mugs, etc.)
• Bedding accessories (protectors)
• Gift cards

Note: These products can still be returned if they are faulty, not fit for purpose, or do not match the sample/description.

Faulty or Mismatched Items

We will provide an exchange voucher, refund, or repair if the product is:

• Faulty or not of acceptable quality.
• Not fit for its intended purpose.
• Does not match the sample or our description.

We reserve the right not to offer a remedy if the fault is a result of misuse or neglect.

Sale Items

FINAL SALE: All items in the Sale Collection are FINAL SALE and cannot be returned.

Promotional Discounts: Items purchased during promotional sales (e.g., Flash Sales) MAY be returned.

How to Initiate a Return

1. Check Criteria: Review the return policy above to ensure your item(s) qualify.
2. Contact the seller directly and complete the Return Form. You will receive a confirmation email—please include a copy of this with your returned item(s).
3. Ship Package: Ship directly to the seller your package via your local Post Shop. We strongly recommend getting a tracking number, as we are not responsible for items lost in transit.

Timeframes for Refunds & Credits

• Refunds (Original Payment): Your package must be postmarked within 7 business days of the original delivery date. It may take 3-5 business days to receive the refunded amount after we process the return.
• Online Credit (Gift Card): Your package must be postmarked within 21 business days of the purchase date. Once processed, you will receive an email with a gift card number for your credit.
• Exchanges: We only exchange items for 7 business days. Please contact the seller directly to reserve the item(s) you want to ensure they don't sell out. After we receive your return, we will contact you with the exact shipping cost for the exchanged item(s).

9. Legal Disclaimers & Limits of Liability

Ownership (Intellectual Property)

This Site, including all Site Content (photographs, images, text, graphics, software, etc., but excluding User Content), is owned by opshop.kiwi or our licensors and is protected by copyright and intellectual property laws. You may not use our trademarks or logos without our express written consent.

Disclaimers (AS IS)

This Site and all services are provided on an "AS IS" and "WITH ALL FAULTS" basis. We make no representations or warranties of any kind, express or implied, regarding the Site's accuracy, completeness, reliability, or that it is free of viruses or errors.

Limitation of Liability

In the event of any product or service issue, your sole and exclusive remedy is to return the product and receive a refund.

opshop.kiwi and its affiliates will NOT be liable for any special, indirect, incidental, or consequential damages (including lost profits or loss of business). Our total liability for any claim arising out of or related to these Terms or the purchase/use of any product will not exceed the purchase price of the product or service.

10. Termination and General Terms

• Termination by You: You can terminate these Terms at any time by closing your account and discontinuing use of the Site.
• Termination by Us:*We reserve the right to terminate your right to use the Site, or any portion of it, without notice, at our sole discretion.
• Indemnification: You agree to defend and hold opshop.kiwi harmless against any claims, damages, or costs (including legal fees) arising from your access or misuse of the Site, your User Content, or your violation of these Terms.
• Governing Law and Dispute Resolution: These Terms are governed by the laws applicable to opshop.kiwi. In the event of a breach, we are entitled to seek specific performance or injunctive relief in addition to any damages.
• Severability: If any provision of these Terms is found to be invalid, that provision will be removed, but the remaining provisions will remain in full force and effect.
• Entire Agreement: These Terms, along with our Privacy Policy, constitute the entire agreement between you and opshop.kiwi regarding the use of this Site.
