OpShop.Kiwi Limited Customer Terms & Conditions

These Terms govern your use of the OpShop.Kiwi website, marketplace, customer account and related services. By accessing, browsing, creating an account or purchasing through OpShop.Kiwi, you agree to these Terms and the policies referred to in them.

1. Acceptance and eligibility

Using OpShop.Kiwi

By using OpShop.Kiwi you agree to these Terms and any policies expressly incorporated into them. If you do not agree, you must not use the marketplace or create an account.

You must be legally capable of entering into the transaction you undertake. If you are under 18, you should use OpShop.Kiwi only with the involvement and supervision of a parent or legal guardian who accepts responsibility for the transaction.

OpShop.Kiwi may update these Terms from time to time. Updated Terms will be published with a revised version or effective date. Changes do not retrospectively remove rights or obligations arising from an order already completed unless required by law.

2. Who operates the marketplace

OpShop.Kiwi and marketplace Stores

OpShop.Kiwi Limited operates the marketplace platform. Products are sold by the Store identified on the product listing, cart, checkout and order record.

Approved Stores may include second hand businesses, charities, community organisations, vintage and antique businesses, consignment businesses and other eligible traders operating in trade.

The selling Store is responsible for the goods it lists and sells, including the accuracy of its product information and its obligations under applicable New Zealand consumer law. OpShop.Kiwi provides the marketplace infrastructure and may support payment processing, order administration, customer support, delivery information and dispute handling.

3. Privacy

How personal information is handled

Use of OpShop.Kiwi is also governed by the published Privacy Policy. Account, order, payment, delivery, communication and support information may be collected and used to provide marketplace services, administer transactions, prevent misuse and meet legal obligations.

Information necessary to complete an order may be shared with the selling Store, payment service providers, delivery providers and other service providers involved in completing the transaction.

4. Accounts and security

Your customer account

You must provide accurate and complete registration information and keep your contact and delivery details current.

You are responsible for protecting your password and account access. You must notify OpShop.Kiwi promptly if you believe your account has been accessed or used without permission.

You must not create accounts using false identities, impersonate another person or use another person's payment or account information without authority.

5. Permitted use

Lawful marketplace access

You receive a limited, non-exclusive right to access and use OpShop.Kiwi for lawful shopping and account purposes.

You must not misuse the Site, interfere with its operation, attempt unauthorised access, introduce malicious software, scrape or systematically extract marketplace information without permission, impersonate OpShop.Kiwi or a Store, misuse customer or Vendor information, or use the marketplace for fraudulent or unlawful activity.

6. Electronic communications

Notices and transaction records

Account, order, payment, delivery, security and service communications may be provided electronically through email, your customer account or notices within the Site.

You agree that electronic agreements, notices, transaction records and disclosures may satisfy requirements for written communication where permitted by law.

7. Customer content

Reviews, messages and feedback

You are responsible for content you submit through OpShop.Kiwi, including reviews, messages, photographs, reports and feedback.

Submitted content must not be unlawful, abusive, threatening, defamatory, knowingly false or misleading, malicious, infringing, discriminatory, fraudulent, or intended to impersonate another person.

OpShop.Kiwi may moderate or remove content where reasonably necessary to operate the marketplace, protect users, enforce these Terms or comply with law.

8. Product listings and second hand goods

Unique products and condition

OpShop.Kiwi specialises in second hand, vintage, antique, collectable and other resale goods. Many products are one off items and may show age, wear, repairs, previous use or other characteristics consistent with second hand goods.

Customers should review the full listing, photographs, measurements, condition information and disclosed faults before purchasing.

A disclosed fault, mark or characteristic does not remove any rights that cannot lawfully be excluded, but customers should take information clearly disclosed before purchase into account when deciding whether an item is suitable.

9. Product availability

One off stock

Many marketplace items are unique and available in quantities of one. Products remain subject to availability until an order and payment have been successfully confirmed.

In unusual circumstances an item may become unavailable because of an inventory error, simultaneous sale, damage, loss or other issue before fulfilment. Where a Store cannot supply a purchased item, the customer will be contacted and the affected amount refunded or otherwise resolved in accordance with applicable law.

10. Prices and errors

Marketplace pricing

Product prices are displayed in New Zealand dollars unless stated otherwise. Delivery and any other applicable charges are shown separately during the purchase process.

OpShop.Kiwi and its Stores take reasonable care with marketplace information, but genuine administrative, technical or pricing errors may occasionally occur.

Where an obvious error materially affects a transaction, OpShop.Kiwi or the selling Store may contact the customer before fulfilment to correct or cancel the affected transaction where lawful to do so. Any payment relating to a properly cancelled order will be refunded.

11. Orders and payment

Completing a purchase

By submitting an order you confirm that the information provided is accurate, that you are authorised to use the selected payment method and that you authorise the complete order charge, including the product price and applicable delivery charges.

Payment is processed through the payment method made available at checkout. An order is treated as successfully paid only after the approved payment provider reports a successful payment result.

A checkout attempt, pending payment or unsuccessful payment does not guarantee allocation of an item.

12. Fraud, payment disputes and chargebacks

Protecting legitimate transactions

OpShop.Kiwi may review, pause, restrict or cancel a transaction where there are reasonable concerns about fraud, unauthorised payment, account misuse, security risk or unlawful activity.

Customers should contact OpShop.Kiwi or the selling Store promptly where there is a genuine problem with an order before initiating an unnecessary payment dispute or chargeback.

Nothing in this section prevents a customer from exercising legitimate rights available through their payment provider or under New Zealand law.

13. Delivery and collection

Receiving your purchase

Available delivery or collection options and applicable charges are shown during the purchase process.

Customers are responsible for providing a complete and accurate delivery address and any information reasonably required to complete delivery.

Where tracking is available, tracking information may be recorded against the order once supplied by the delivery provider.

Delivery timeframes are estimates unless expressly stated otherwise. Delays may occur because of carriers, weather, address issues, regional disruption or other circumstances outside the reasonable control of the Store or OpShop.Kiwi.

14. Returns, refunds and customer remedies

When something is not right

Faulty, unsafe, materially misdescribed or otherwise non-compliant goods are handled in accordance with applicable New Zealand consumer law and the published Returns process.

Nothing in these Terms excludes, restricts or modifies rights or remedies that cannot lawfully be excluded or restricted, including applicable rights under the Consumer Guarantees Act 1993 and Fair Trading Act 1986.

Change of mind returns are not automatically required by law and apply only where offered by the selling Store or otherwise agreed.

Where supported, customers should begin a return or support request from the relevant order so the product, seller, payment, delivery and communication records remain connected.

15. Marketplace support and disputes

Resolving order problems

Customers should raise order problems promptly through the available Store contact, order support or OpShop.Kiwi support process.

OpShop.Kiwi may assist customers and Stores to review transaction information and resolve marketplace disputes, but doing so does not replace the legal responsibilities of the selling Store or the rights of the customer.

Customers and Stores are expected to provide accurate information and cooperate reasonably with requests for photographs, tracking information, order records or other information relevant to resolving an issue.

16. Intellectual property

Site content and branding

OpShop.Kiwi branding, platform content, design, software and other material owned by OpShop.Kiwi remain the property of OpShop.Kiwi Limited.

Product photographs, descriptions, trademarks and other Store supplied material may be owned by the applicable Store or other rights holder.

You must not reproduce, commercially exploit or falsely represent protected marketplace content without appropriate permission.

17. Third party services

Payments, delivery and external services

OpShop.Kiwi may rely on third party providers for services such as payments, delivery, hosting, communications and other marketplace functions.

Those services may also be subject to the provider's applicable terms, service conditions and privacy practices.

18. Availability of the platform

Website and service access

OpShop.Kiwi aims to provide reliable access to the marketplace but does not guarantee uninterrupted or error free operation.

Access may occasionally be affected by maintenance, upgrades, security work, hosting issues, network failures or circumstances outside OpShop.Kiwi's reasonable control.

19. Liability and lawful limits

Rights that cannot be excluded remain protected

Nothing in these Terms excludes, restricts or modifies any statutory guarantee, right, remedy or liability that cannot lawfully be excluded or restricted.

To the extent permitted by law, OpShop.Kiwi is not responsible for losses caused solely by circumstances outside its reasonable control, customer misuse, inaccurate information supplied by the customer, or unauthorised use of a customer account where OpShop.Kiwi has taken reasonable security measures.

20. Suspension and termination

Ending or restricting access

You may stop using OpShop.Kiwi at any time and may request closure of your customer account subject to any records that OpShop.Kiwi must retain for legal, accounting, fraud prevention, dispute or transaction purposes.

OpShop.Kiwi may suspend, restrict or terminate access where reasonably necessary because of fraud, security risk, unlawful conduct, repeated misuse, abusive behaviour, material breach of these Terms or conduct that threatens the marketplace or its users.

Account suspension or closure does not remove obligations relating to completed transactions or unresolved orders.

21. General terms

New Zealand law

These Terms are governed by New Zealand law.

If any provision is found to be invalid, unlawful or unenforceable, the remaining provisions continue to apply to the extent permitted by law.

A failure or delay by OpShop.Kiwi to enforce a provision does not automatically waive the right to enforce it later.

These Terms, together with the Privacy Policy, Returns information and other policies expressly incorporated into them, form the agreement governing customer use of the OpShop.Kiwi marketplace.
